If the buyer fails to meet the terms of the agreement a punitive fee of not less than $1000 or the purchase price of dog must be paid to seller within 1 year of breaking the contract.

Additional terms:
The buyer agrees that this dog will be shown in AKC conformations shows with the goal of attaining the title of champion. This dog is being sold with full registration with the following marked conditions:
____ Co-ownership with breeder/seller for not less than 2 years or until both seller and buyer agree to change the ownership of the dog
____ Seller will sign off after transfer of "payback" puppy or puppies ________________________________________________
____ All breeding involving this dog must be approved by both co-owners (buyer and seller).

The purchaser agrees to never sell or give this dog or the descendants of this dog to any irresponsible breeder, pet store, commercial pet farm, puppy-mill or similar institution. If buyer is at any time unable or unwilling to keep dog, dog is to be returned to seller.  If dog is returned to seller for any reason other than stated in guarantee any refund of purchase price or replacement is at the discretion of seller and will at no time be more than 50% of purchase price.  The purchaser also agrees to consider the polices of the seller in future decisions about this dog and its descendants. Polices include: selling pet quality puppies with spay neuter contracts and limited registration, careful screening of potential buyers, breeding this dog only to quality, healthy dogs, being a source of knowledge and assistance to new owners, and representing the ancestors of this dog with honesty, consideration and dignity.

Guarantee:
It is understood that at the time of sale this dog is considered to be of show or breeding potential, and is representative of its breed and structurally and temperamentally suited as a companion and/or competition dog. At the time of sale this dog has no disqualifiable faults according to the AKC standard for the Cocker Spaniel.  This dog is guaranteed for ten days, as stated in Pennsylvania’s “Puppy Lemon Law”, and it is recommended that the buyer have the dog examined by a veterinarian during this time period.  If during this time period the buyer believes the dog to be sick, the buyer agrees to return it to the seller, with a letter from the examining licensed veterinarian, and the seller will refund the purchase price.

No other guarantee is given except in the case of a hereditary defect which develops to the extent that it renders the dog unsuitable as a companion, competitive or breeding animal. In this instance, a replacement of the seller’s choice, but agreeable to both parties, will be given as soon as one becomes available.  Hereditary defects which shall be included in this guarantee shall be:  Juvenile cataracts or PRA, as diagnosed by a Certified Canine Ophthalmologist;  Hip Displasia, as diagnosed by OFA or Penn Hip;  Thyroid disease, diagnosed by laboratory studies; or heart disease proven to be genetic in nature.

The seller assumes no responsibility for this dog after leaving the premises; medical expenses, landlord’s disapproval, allergy to animals, disagreement of family, legal liability or for any other reason, other than stated.
